Terms of Service

These Terms of Service (“Terms”) govern your use of the vMaint software service operated by Ender Celik (“vMaint”, “we”, “us”). By creating an account you agree to these Terms.
1. The service
vMaint is a web-based maintenance management system (CMMS) that allows organizations to manage assets, work orders, parts inventory, preventive maintenance schedules, and team coordination. The service is provided “as is” and we may update or modify features at any time.
2. Accounts and organizations
- You must be at least 16 years old to create an account.
- You are responsible for keeping your password secure.
- Each organization is an isolated workspace. The person who creates the org is the owner and is responsible for the org’s use of vMaint.
- You may invite team members to your organization. You are responsible for their activity within your org.
- You may not share your account with others or create accounts on behalf of someone else without authorization.
3. Trial and billing
- New organizations start on a free plan — no credit card required. A one-time 14-day trial of the Pro plan can be started from inside the app.
- Paid plans are billed per seat, per month via Stripe — Starter and Pro tiers, at the prices listed on our pricing page — or under a custom Enterprise agreement. Operators are always free and never count as billable seats.
- You can cancel any time from the billing page — access continues until the end of the billing period, then the organization returns to the free plan (your data is kept).
- We reserve the right to change pricing with 30 days’ notice to active subscribers.
- Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge if you believe it was made in error.
4. Acceptable use
You agree not to:
- Use vMaint for any unlawful purpose or in violation of any regulations.
- Attempt to gain unauthorized access to any part of the service or another organization’s data.
- Reverse-engineer, decompile, or copy any part of the service.
- Upload malicious code, spam, or content that violates third-party rights.
- Abuse the service in a way that degrades performance for other users.
5. Your data
You own the data you enter into vMaint. We do not claim any rights over it. By using the service you grant us a limited license to store, process, and display your data solely to provide the service to you.
We will handle your data in accordance with our Privacy Policy.
6. Intellectual property
vMaint’s software, design, and content (excluding your data) are owned by Ender Celik. Nothing in these Terms transfers any IP rights to you beyond the limited right to use the service.
7. Uptime and availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (hosting, database, payment provider), or events outside our control may cause downtime. We are not liable for losses caused by service interruptions.
8. Limitation of liability
To the maximum extent permitted by law, vMaint and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising from your use of or inability to use the service, even if advised of the possibility of such damages.
Our total liability to you for any claim shall not exceed the amount you paid to us in the 3 months preceding the claim.
9. Termination
You may delete your organization and account at any time. We may suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your data will be deleted within 30 days.
10. Changes to these Terms
We may update these Terms. We will notify active users by email at least 14 days before material changes take effect. Continued use after the effective date means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
